Campus Activewear Ltd., an industry leader in sports and casual footwear, filed a trademark infringement and passing off suit against Campus Sutra Retail Pvt. Ltd., a youth fashion label.

The issue centers on Sutra’s use of “Campus” alone as seen on certain apparel and accessories allegedly overlapping with the established “Campus Activewear” brand.

Campus Activewear claims that standalone use of “Campus”on Campus Sutra’s products creates confusion, dilutes its brand identity, and misleads consumers into believing there’s affiliation or endorsement.

They seek a permanent injunction, along with legal recognition that Sutra’s use is infringing and misleading to its longstanding clientele.

Sutra points out that its full brand name “Campus Sutra” has been in continuous use since 2012, and it did not independently use “Campus” alone for footwear.

Any isolated use of "Campus" on apparel items was inadvertentand digital-only. Once identified, these listings were promptly withheld or removed.

As a gesture of goodwill, Sutra submitted an undertaking to refrain from using “Campus” by itself until the next hearing.

Justice Amit Bansal recorded Sutra’s assurance and issued notice for Campus Activewear’s plea.

The Court scheduled the matter for further hearings on interim relief, pending a final decision.

Both parties appeared via top counsel: Sandeep Sethi representing Campus Activewear, and Amit Sibalappearing for Campus Sutra.
