Fee Increase in US for Trademark Applications

On November 16, 2020, the United States Patent and Trademark Office announced that effective January 2, 2021, certain Trademark and Trademark Trial and Appeal Board fees are set to increase. The Final Rule, which was originally scheduled to be implemented earlier in 2020, is intended to allow the Patent and Trademark office to enhance the quality of trademark examination, optimize examination times, modernize trademark information technology systems and infrastructure, and provide stability for PTO operations.

The most significant changes are as follows:

Trademark Applications

• The fee for filing an Application through the Trademark Electronic Application System (TEAS) will be $350 per class – up from $275 per class.


• The fee for filing a TEAS Plus Application with descriptions of goods and services already approved by the Trademark Office will be $250 per class – up from $225 per class.


• The fee for filing an application Madrid Protocol will be $500 per class – up from $400 per class.

Declarations of Use

• Declarations of Use under Sections 8 or 71 will be $225 per class – up from $125 per class.

Given the upcoming adjustments to trademark fees, we strongly encourage you to review their trademark portfolios and consider what actions can be taken before January 2, 2021, to lessen the cost of filing new applications, maintaining existing registrations.
